What are the reasons for collecting and using personal data?
The office fulfils the functions and duties of a Member of Parliament who receives constituent queries and casework. This requires us to process personal data of our constituents. The office takes up casework on behalf of constituents, asks for views on issues and advises on local events. This includes through surveys. We also have a mailing list for sending newsletters and updates about the work of the Member of Parliament.
The office processes constituents’ data under the lawful basis of fulfilling a public task. When this lawful basis is not sufficient and explicit consent is required, a member of the office will contact you.
What data is collected?
When you contact my office I will normally need to store your contact details in order to progress your inquiry and to keep you updated about this. Under GDPR, this would be considered normal category data.
Other personal data that you might provide could include details about your personal life, social circumstances, education and employment details, financial information, health status or housing information for example. These could be considered special category data.
Who do you share data with?
If you have contacted my office about a personal or policy-related issue, we may pass your personal data on to a third party in order to progress your inquiry. This could include local authorities (for example Fife Council or Clacks Council), government agencies (for example the DWP or HMRC) and other public bodies (for example the NHS, or the Police). Any third parties that we share your data with, have to keep your details securely and can only use them for the reason that they were originally shared.
We will not share the personal information of members of any mailing list or those in receipt of newsletters.
We will not use your data in any way which goes beyond your reasonable expectations when you contact my office.
How long will you keep my personal data for?
Unless you ask otherwise, my office will hold your personal data for the duratio of my time as a Member of Parliament. In the event that I leave Parliament, all records will be destroyed. If your casework is not concluded, I will seek your permission to pass it on to my successor as MP for the constituency.
What are my rights with regards to my personal data?
- Right to be informed: You have the right to be informed about the collection and use of your personal data.
- Right of access: You have the right to access and receive a copy of your personal data, and other supplementary information.
- Right to rectification: You have the right to have inaccurate personal data rectified, or completed if it is incomplete.
- Right to erasure: You have the right to have personal data erased.
- Right to restrict processing: You have the right to request the restriction or suppression of your personal data.
- Right to data portability: You have the right to obtain and reuse your personal data for your own purposes across different services.
- Right to object: You have the right to object to the processing of their personal data in certain circumstances.
- Rights related to automated decision making including profiling
The UK GDPR has provisions on:- automated individual decision-making (making a decision solely by automated means without any human involvement); and
- profiling (automated processing of personal data to evaluate certain things about an individual). Profiling can be part of an automated decision-making process.
